ACCEPTABLE USE POLICY


The Integral Hosting Acceptable Use Policy (the "Usage Policy") govern the general policies and procedures for use of the Services. The Usage Policy is posted on Integral Hosting's Web site (or such other location as Integral Hosting may specify) and may be updated from time-to-time

YOU SHOULD CAREFULLY READ THE USAGE POLICY. BY USING THE SERVICES, YOU AGREE TO BE BOUND BY THE TERMS OF THE USAGE POLICY AND ANY MODIFICATIONS. Integral HOSTING RESERVES THE RIGHT TO TERMINATE YOUR ACCOUNT FOR ANY VIOLATION OF THE USAGE POLICY OR THIS AGREEMENT.

The following constitute violations of this AUP:


DMCA Violation and take down procedure:

When a DMCA violation has been reported, each customer is notified and is given 24 hours to send us back a proper response or remove the pages/material in violation. After the 24 hour period, the site is suspended until we receive proper correspondence. The second and third violations result in an automatic account suspension and a fourth violation will cause an account removal.


Illegal use:

Integral services may not be used for illegal purposes, or in support of illegal activities. Integral reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.


Harm to minors:

Use of the Integral service to harm, or attempt to harm, minors in any way, including, but not limited to child pornography.


Threats:

Use of Integral service to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property.


Harassment:

Use of Integral service to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another.


Fraudulent activity:

Use of Integral service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes," and "chain letters."


Forgery or impersonation:

Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.


Unsolicited commercial e-mail / Unsolicited bulk e-mail (SPAM):

Use of the Integral Hosting service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violations of this type will result in the immediate termination of the offending Integral Hosting account.


Bulk Mailings:

Bulk mailings of any kind are not permitted to be sent from our shared (Personal, Business, Reseller) servers. This line item applies to mailings sent within the 1000 emails per hour limit as well.


E-mail / News Bombing:

Malicious intent to impede another person's use of electronic mail services or news will result in the immediate termination of the offending Integral account.


E-mail / Message Forging:

Forging any message header, in part or whole, of any electronic transmission, originating or passing through the Integral service is in violation of this AUP.


Unauthorized access:

Use of the Integral service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Integral or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending Integral account is subject to immediate termination.


Copyright or trademark infringement:

Use of the Integral service to transmit any material (by e-mail, uploading, posting or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.


Collection of personal data:

Use of the Integral service to collect, or attempt to collect, personal information about third parties without their knowledge or consent.


Free Hosting/Image Hosting Providers:

Use of the Integral service (shared hosting accounts) to provide free hosting or image hosting to the general public is illegal.


Reselling of Services:

Shared services, except for ResellerClass accounts, can only be resold to a single party. Our shared plans were not designed to host several different organizations and parties.


Network disruptions and unfriendly activity:

Use of the Integral service for any activity which affects the ability of other people or systems to use Integral Services or the Internet. This includes "denial of service" (DOS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member's responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorized entry and/or use of another company and/or individual's computer system will result in immediate account termination. Integral will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.


Fraud:

Involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it. Infringement of Copyright, Patent, Trademark, Trade Secret, or Intellectual Property Right: Distribution and/or posting of copyrighted or the aforementioned infringements will not be tolerated.


Distribution of Viruses:

Intentional distributions of software that attempts to and/or causes damage, harassment, or annoyance to persons, data, and/or computer systems are prohibited. Such an offense will result in the immediate termination of the offending account.


Inappropriate Use of Software:

Use of software or any device that would facilitate a continued connection, i.e. pinging, while using Integral services could result in suspension service.


Verbal abuse of support personnel:

Verbal abuse of Integral personnel is not tolerated. Customers who continue to verbally abuse support personnel may be warned or asked to use a different provider.


Third Party Accountability:

Integral Hosting subscribers will be held responsible and accountable for any activity by third parties, using their account, that violates guidelines created within the Acceptable Use Policy.


REPORTING VIOLATIONS OF Integral AUP

Integral requests that anyone who believes that there is a violation of this AUP direct the information to the abuse department. The email address is abuse@Integralhost.net
If available, please provide the following information:
* The IP address used to commit the alleged violation
* The date and time of the alleged violation, including the time zone or offset from GMT
* Evidence of the alleged violation
* E-mail with full header information provides all of the above, as do system log files.
* Other situations will require different methods of providing the above information.


Material and Product Requirements:

Unless we have agreed otherwise in a separate agreement, you must ensure that all material and data placed on Integral Hosting's equipment is in a condition that is "server-ready," which is in a form requiring no additional manipulation by Integral Hosting. Integral Hosting will make no effort to validate any of this information for content, correctness or usability. If your material is not "server-ready", Integral Hosting has the option at any time to reject this material. Integral Hosting will notify you of its refusal of the material and afford you the opportunity to amend or modify the material to satisfy the needs and/or requirements of Integral Hosting. Use of the Services requires a certain level of knowledge in the use of Internet languages, protocols and software. This level of knowledge varies depending on the anticipated use and desired content of your Web site. You must have the necessary knowledge to create and maintain a Web site. It is not Integral Hosting 's responsibility to provide this knowledge or customer support outside of the Services agreed to by you and Integral Hosting .


ENFORCEMENT

Investigation of Violations

Integral Hosting may investigate any reported or suspected violation of this Agreement, its policies or any complaints and take any action that it deems appropriate and reasonable under the circumstance to protect its systems, facilities, customers and/or third parties. Integral Hosting will not access or review the contents of any e-mail or similar stored electronic communications except as required or permitted by applicable law or legal process.


Actions

Integral Hosting reserves the right and has absolute discretion to restrict or remove from its servers any content that violates this Agreement or related policies or guidelines, or is otherwise objectionable or potentially infringing on any third party's rights or potentially in violation of any laws. If we become aware of any possible violation by you of this Agreement, any related policies or guidelines, third party rights or laws, Integral Hosting may immediately take corrective action, including, but not limited to, (a) issuing warnings, (b) suspending or terminating the Service, (c) restricting or prohibiting any and all uses of content hosted on Integral Hosting 's systems, and/or (d) disabling or removing any hypertext links to third party Web sites, any of your content distributed or made available for distribution via the Services, or other content not supplied by Integral Hosting which, in Integral Hosting 's sole discretion, may violate or infringe any law or third-party rights or which otherwise exposes or potentially exposes Integral Hosting to civil or criminal liability or public ridicule. It is Integral Hosting 's policy to terminate repeat infringers. Integral Hosting's right to take corrective action, however, does not obligate us to monitor or exert editorial control over the information made available for distribution via the Services. If Integral Hosting takes corrective action due to such possible violation, Integral Hosting shall not be obligated to refund to you any fees paid in advance of such corrective action.


Disclosure Rights

To comply with applicable laws and lawful governmental requests, to protect Integral Hosting 's systems and customers, or to ensure the integrity and operation of Integral Hosting 's business and systems, Integral Hosting may access and disclose any information it considers necessary or appropriate, including, without limitation, user profile information (i.e., name, e-mail address, etc.), IP addressing and traffic information, usage history, and content residing on Integral Hosting's servers and systems. Integral Hosting also reserves the right to report any activity that it suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other appropriate third parties.


WARRANTY; WARRANTY DISCLAIMER

Customer and/or Third Party Acts

Integral Hosting is not responsible in any manner for any non-confirming Services to the extent caused by you or your customers. In addition, Integral Hosting is not responsible for loss or corruption of data in transmission, or for failure to send or receive data due to events beyond Integral Hosting's reasonable control.


No Express or Implied Warranty

ALL SERVICES, SYSTEMS AND PRODUCTS PROVIDED BY Integral HOSTING UNDER THIS AGREEMENT ARE PROVIDED WITHOUT ANY EXPRESS OR IMPLIED WARRANTY IN FACT OR IN LAW, WHATSOEVER. YOU ACKNOWLEDGE AND AGREE THAT Integral HOSTING EXERCISES NO CONTROL OVER, AND ACCEPTS NO RESPONSIBILITY FOR, THE CONTENT OF THE INFORMATION PASSING THROUGH Integral HOSTING's COMPUTERS, NETWORK HUBS AND POINTS OF PRESENCE, OR THE INTERNET. Integral HOSTING DOES NOT WARRANT THAT THE OPERATION OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR COMPLETELY SECURE, AND DOES NOT MAKE ANY WARRANTIES WITH RESPECT TO PATENT, COPYRIGHT, TRADE SECRET OR TRADEMARK INFRINGEMENT. ALL SERVICES PERFORMED UNDER THIS AGREEMENT ARE PERFORMED "AS IS" AND WITHOUT WARRANTY AGAINST FAILURE OF PERFORMANCE INCLUDING, WITHOUT LIMITATION, ANY FAILURE DUE TO COMPUTER HARDWARE OR COMMUNICATION SYSTEMS. EXCEPT AS EXPRESSLY PROVIDED IN THIS AGREEMENT, Integral HOSTING DOES NOT MAKE AND HEREBY DISCLAIMS, AND YOU HEREBY WAIVE ALL RELIANCE ON, ANY REPRESENTATIONS OR WARRANTIES, ARISING BY LAW OR OTHERWISE, REGARDING THE SERVICES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR CONDITIONS OF QUALITY, AND ANY WARRANTIES WITH RESPECT TO PATENT, COPYRIGHT, TRADESECRET OR TRADEMARK INFRINGEMENT.


Your Warranties and Representations to Integral Hosting

You warrant, represent, and covenant to Integral Hosting that (a) you are at least eighteen (18) years of age or are a duly organized and validly existing entity; (b) you possess the legal right and ability to enter into this Agreement; (c) you will use the Services only for lawful purposes and in accordance with this Agreement and all applicable policies and guidelines; (d) you will be financially responsible for the use of your account; (e) you have acquired or will acquire all authorization(s) necessary for hypertext links to third-party Web sites or other content; (f) you have verified or will verify the accuracy of materials distributed or made available for distribution via the Services, including, without limitation, your content, descriptive claims, warranties, guarantees, nature of business, and address where business is conducted, and (g) your content and/or any software that you install or provide does not and will not infringe or violate any right of any third party (including any intellectual property rights) or violate any applicable law, regulation or ordinance.


REVISIONS TO THIS ACCEPTABLE USE POLICY

Integral reserves the right to revise, amend, or modify this AUP, our TOS (Terms of Service) and our other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with our TOS (Terms of Service).
